Terms of Service

These Terms of Service (“Terms”) explain the rules for using Echo Root, including the Echo Root mobile application and related websites (together, the “Service”). This page is provided for informational clarity and is not legal advice from a law firm.

1. Acceptance of the Terms

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use Echo Root.

2. Eligibility and Minimum Age

You must be old enough to form a binding agreement in your location and meet any minimum age requirements that apply to app-store accounts and location services. If you are under the age of majority where you live, you may use Echo Root only with permission from a parent or legal guardian where required by law.

3. Accounts and Account Security

Echo Root may allow guest, anonymous, or signed-in use. You are responsible for activity that occurs through your device and any credentials associated with your account. Notify us at [email protected] if you believe your account has been compromised.

4. Anonymous and Pseudonymous Participation

Echo Root is designed so users can leave and discover content without displaying a real-world identity to other users. Anonymous or pseudonymous presentation does not mean the Service has no internal identifiers, and it does not make activity completely untraceable for safety, abuse prevention, legal process, or account administration.

5. User-Created Audio and Text Content

You may submit audio, text, and related metadata as time capsules (“User Content”). You are solely responsible for User Content you create, plant, or attempt to distribute. Do not submit content you do not have the right to share.

6. License Needed to Store and Display Submitted Content

By submitting User Content, you grant Echo Root a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt for technical delivery, display, and distribute that content as needed to operate, moderate, and improve the Service. This license ends when User Content is removed from our systems, except for reasonable residual copies in backups or logs that are deleted in the ordinary course, and except where retention is required for safety, legal, or abuse-prevention reasons.

7. Ownership of User Content

Subject to the license above and applicable law, you retain ownership of your User Content. Echo Root and its licensors retain all rights in the Service, branding, software, and design.

8. Location Services and Geo-Locked Capsules

Capsules are tied to physical locations. Precise location may be required to plant or unlock content, and approximate location may be used to show nearby discoveries. Location accuracy depends on your device, permissions, environment, and third-party systems. Echo Root does not guarantee that every unlock attempt will succeed.

9. Public-Place and Anti-Trespassing Requirements

Echo Root is intended for publicly accessible places. You agree not to trespass, enter private property without permission, bypass barriers, ignore posted restrictions, or place yourself or others at risk to plant or unlock a capsule. Capsule placement near a location does not mean entry is lawful or safe.

10. Prohibited Content and Behavior

You may not use Echo Root to:

  • Violate laws or the rights of others
  • Spam, scrape, reverse engineer, or disrupt the Service
  • Impersonate others in a misleading or harmful way
  • Plant capsules intended to lure people into unsafe or restricted places
  • Attempt to bypass geo-locking, moderation, or rate limits

11. Harassment, Threats, Hate Speech, Doxxing, and Illegal Activity

Harassment, threats, hate speech, doxxing, sexual exploitation, stalking, and other illegal or abusive activity are prohibited. We may remove content, suspend access, and report conduct where appropriate.

12. False or Dangerous Warnings

Do not post false emergency claims, fabricated hazards, or misleading warnings that could cause panic, harm, or unnecessary risk. Capsules are user-created and are not professionally verified historical records.

13. Intellectual-Property Infringement

Do not upload content that infringes copyrights, trademarks, or other intellectual-property rights. If you believe content on Echo Root infringes your rights, contact [email protected] with enough detail for us to evaluate the report.

14. Content Reporting, Moderation, Removal, and Account Suspension

Users may report content. Echo Root may review, hide, remove, or restrict content and may suspend or terminate accounts that violate these Terms or create risk. Moderation decisions may be imperfect and are not a guarantee that all harmful content will be found or removed immediately.

15. Location Accuracy and Availability Limitations

GPS drift, indoor environments, device settings, network conditions, and map data can affect discovery and unlock. The Service may be unavailable, delayed, or changed at times.

16. Expired, Deleted, Inaccessible, or Moderated Capsules

Capsules may expire, be deleted by their creators where supported, become inaccessible due to location or technical limits, or be removed through moderation. We do not guarantee permanent availability of any capsule.

17. Third-Party Maps, App Stores, and External Services

The Service may rely on third-party maps, hosting, analytics, authentication, notifications, and app-store platforms. Those services are governed by their own terms and privacy practices. Echo Root is not responsible for third-party outages or policy changes.

18. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECHO ROOT DISCLAIMS WARRANTIES OF MERCHANTABILITY, SUITABILITY FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that capsules are accurate, complete, safe to pursue, or appropriate for every user.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECHO ROOT AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US $100), IF APPLICABLE LAW ALLOWS SUCH A LIMIT.

20. Indemnification

You agree to defend and indemnify Echo Root and its operators against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your misuse of the Service, or your violation of these Terms or applicable law, to the extent permitted by law.

21. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if needed to protect users or the Service. Provisions that by their nature should survive termination will survive.

22. Changes to the Service or Terms

We may update the Service and these Terms from time to time. When we make material changes, we will update the “Last updated” date and may provide additional notice in the app or on the website. Continued use after changes become effective means you accept the revised Terms.

23. Governing Law

These Terms are governed by the laws of the jurisdiction in which the Echo Root operator is established, without regard to conflict-of-law rules, except where mandatory local consumer protections apply. If a specific governing-law location is later designated in an updated version of these Terms, that designation will control.
